Naumah Care mobile app(s), and services delivered at Naumah Care clinic, Ghaziabad (including OPD, procedures, admissions at partner hospitals).

1. Definitions

  • “Clinic”, “we”, “our”: Naumah Care, Ghaziabad (legal entity details and CIN/GST to be inserted).
  • “Patient”, “you”, “user”: Any person accessing our website/app or availing services at the clinic/partner hospitals.
  • “RMP”: Registered Medical Practitioner as per the Indian Medical Council Act/NMC Act. Telemedicine practice is governed by India’s Telemedicine Practice Guidelines, 25 Mar 2020, appended to the ethics regulations.

2. Scope of Services

We provide outpatient consultations and specialty services in: High‑Risk Pregnancy, Normal Delivery/C‑Section (at accredited partner hospitals), Laparoscopic Surgeries, Hysteroscopic Procedures, Adolescent Health, PCOS, Fertility Solutions (as per the ART Act 2021 and Rules 2022), Stem‑cell related counselling (strictly per ICMR/DBT guidance; no unproven therapies), Vaccinations, Health Counselling, Sexual Health, Yoga & Meditation. ART/Surrogacy services—where applicable—comply with national law and are rendered only through registered clinics/banks.

3. No Emergency Care Promise

Our clinic is not an emergency department. In emergencies, call 112/102 or go to the nearest hospital. RMPs may provide limited tele‑advice in emergencies (first aid/referral) but should not be compelled to manage emergencies via telemedicine.

4. Patient Responsibilities

You agree to:

  • Provide accurate identity, medical history, allergies, medications, reports, and contact details.
  • Follow pre‑/post‑procedure instructions and attend follow‑ups.
  • Refrain from recording/streaming consultations without explicit permission (privacy & dignified care).
  • Comply with PCPNDT law—no sex selection inquiries will be entertained.

5. Informed Consent & Specific Risk Disclosures

Before any clinical/diagnostic/surgical/ART/MTP/vaccination procedure, you will receive procedure‑specific informed consent detailing indications, alternatives, benefits, risks, possible complications, failure rates, anesthesia/blood transfusion risks, need for referral/transfer, and potential costs. For pregnancy termination, the MTP (Amendment) Act, 2021 requirements apply (gestational limits, confidentiality, medical board where applicable). For ultrasound in pregnancy, records and Form‑F obligations under PCPNDT apply. For ART and Surrogacy, statutory consent forms and eligibility checks are mandatory.

6. No Guarantee of Outcome

While we follow evidence‑based standards, medical outcomes cannot be guaranteed. Counselling shall reflect reasonable skill and care as required by Indian medical ethics and applicable regulations.

7. Telemedicine Terms

  • Identification of RMP and patient is mandatory; consent may be explicit or implied depending on mode.
  • Tele‑prescription follows the Telemedicine Practice Guidelines lists and restrictions. Narcotics/some Schedule drugs cannot be prescribed over teleconsults.
  • The RMP may ask for in‑person evaluation or investigations if clinically needed; may discontinue tele‑consult with due notice. Fees for teleconsults are chargeable.

8. Ultrasound/Imaging & PCPNDT Compliance

  • All ultrasound services are provided only at registeredcentres; no sex determination.
  • Mandatory display of certificates/messages, maintenance of Form F, monthly reporting, record retention for minimum 2 years (longer if litigation).
  • Only qualified registered doctors listed for that centre may operate machines; movement/changes must be notified to the Appropriate Authority.

9. ART/Infertility & Surrogacy Compliance

  • ART procedures are available only at registered ART clinics/banks; detailed eligibility, consents, counselling, gamete/embryo handling and prohibition of sex selection will be followed under the ART Act 2021 and ART Rules 2022.
  • Surrogacy, if applicable, is only altruistic, with registration, state/national boards’ oversight, insurance for surrogate (36 months), embryo transfer limits, and statutory forms under Surrogacy Act 2021 and Rules 2022.

10. Stem Cell Advisory

Naumah Care does not offer unproven stem‑cell therapies. Any discussion is limited to counselling and referrals consistent with ICMR/DBT National Guidelines and ICMR 2021 evidence status (beyond hematopoietic indications, most uses remain experimental and regulated).

11. Vaccinations

Cold‑chain, consent, contraindications, and adverse event reporting are followed as per national guidelines; biomedical waste is handled under BMW Rules 2016 (amended 2018/2019).

12. Fees, Payments, Refunds & Cancellations

  • Consultation/Procedure Fees: Displayed at reception and/or app before booking.
  • Deposits & Packages: For surgeries/ART/obstetric packages, deposits may be required; itemized estimates provided.
  • Cancellations/No‑Show: [Define policy e.g., <4 hours cancellation incurs fee].
  • Refunds: Professional fees for services already rendered are non‑refundable; prepaid packages refundable pro‑rata after deducting services consumed and administrative charges.
  • Insurance/TPA: Where applicable, documentation support is provided; ultimate liability rests with the patient/insurer contract.
  • Digital Payments: Processed through compliant gateways; invoices carry RMP/NMC registration number(s) as required.

13. Clinical Establishment Registration & Quality

The clinic will display valid Clinical Establishment Registration and comply with U.P. Clinical Establishments Rules, 2016 (records, returns, display, registers, renewals). We follow minimum standards and may align with NABH standards as adopted.

14. Biomedical Waste Management

We segregate, barcode, store, and hand over BMW to authorized CBWTF as per BMW Rules, 2016 and 2018/2019 amendments (phase‑out of certain chlorinated plastics; annual reporting and tracking).

15. Privacy, Data & Records (Summary)

We protect medical records and personal data under the Digital Personal Data Protection Act, 2023 (DPDPA) and the IT/SPDI Rules, 2011 till DPDP Rules are fully operationalized. You have rights to access/correction/erasure (as per law), and we retain medical records as legally required (e.g., PCPNDT/MTP/CEA). Details are in our Privacy Policy below.

16. Website/App Use

  • Content is informational and not a substitute for in‑person medical advice.
  • Prohibited: scraping, impersonation, security breaches, uploading unlawful content, or misuse of appointment systems.
  • We may update, suspend, or discontinue features; we are not liable for third‑party links/platform outages.

17. Complaints & Dispute Resolution
